Kentucky Extends Community-Based Housing & Services To 600 Personal Care Home Residents With SMI (OPEN MINDS Weekly News Wire Book 2013)

On August 16, 2013, the Kentucky Cabinet for Health and Family Services (CHFS) announced it had agreed to extend community-based housing and services to 600 personal care home (PCH) residents with serious mental illness (SMI). CHFS had been in negotiations with Kentucky Protection and Advocacy (P&A) to settle a complaint filed by P&A and avoid having the complaint go to litigation. P&A alleged that the state’s PCHs functioned as long-term care facilities and that by failing to develop community-based housing and services the state violated the Americans with Disabilities Act (ADA) and discriminated against persons with disabilities by segregating them in the personal care homes. CHFS will also provide services and supports to individuals who are at-risk of residing in a PCH.
